Please read carefully: This document sets out important legal obligations that govern your use of our services, and your continued use of Illevante’s services is deemed implied acceptance of it.

1. General provisions - scope of application

In plain languageThese terms govern all your dealings with us, we amend them with prior notice, no oral agreement counts, and you must be of age to contract.

1.1. The following terms and conditions apply to all business relationships between the customer and Illevante Internet Services LLC in Aleppo, Syria, hereinafter referred to as “we”. Illevante Internet Services is in a partnership relationship with Illevante Cloud LLC (United Arab Emirates), and this partnership does not change the fact that the party contracting with the customer is Illevante Internet Services LLC. These terms and conditions form an integral part of all contracts concluded with the customer. These terms and conditions also apply to future services and offers, even if the customer does not separately agree to them again.

1.2. The terms and conditions of our customers or of third parties do not apply and do not form part of the contract, even in cases where we do not separately object to their application in individual cases.

1.3. We expressly reserve the right to make changes to our terms and conditions, system policies and prices, provided that prior notice is given to the customer through their account or to the email address listed in their contact information.

1.4. The Privacy Policy, the Acceptable Use Policy, the Zero-Spam Policy, the Data Processing Agreement and the Expired Domain Recovery Policy, published in the legal center on our website, form part of these terms and conditions. Where these documents conflict, what was agreed in writing in the order or the service description prevails, and then the specific provision prevails over the general one.

1.5. Our employees and third parties authorized by us are not entitled to make any oral agreements or to give the customer any oral guarantees or commitments.

1.6. Where domain names are the subject of this contract, the rules and policies of the authority responsible for the extension concerned also apply: the conditions of NAITS (the National Agency for Information Technology Services) for the Syrian national domain .sy and its extensions; the policies of the Internet Corporation for Assigned Names and Numbers (ICANN) and of the registry concerned for generic top-level domains (gTLDs); and the rules of each extension’s registry for other country-code domains (ccTLDs).

1.7. The customer confirms that they have full legal capacity to contract under the Syrian Civil Code, having reached the age of majority, which is eighteen full calendar years. If the customer contracts in the name of a legal person, they confirm that they are authorized to bind it to these terms and conditions; otherwise they are bound by them personally, including the payment obligations.

2. Conclusion, term and termination of the contract

In plain languageThe contract starts when we accept your order, is concluded electronically with full legal effect, and runs until either party ends it with notice 30 days before the end of a month.

2.1. The contract is deemed concluded when the customer submits their order and we accept that order in accordance with paragraph (2.4) of these terms and conditions.

2.2. Our offers are subject to change and non-binding. We reserve the right to make technical or other changes within reasonable limits.

2.3. The customer confirms that the data provided in their account is correct and complete, and undertakes to notify us in writing of any changes to it within no more than 14 days. The customer also undertakes to provide evidence of the accuracy of the data on request.

2.4. The customer enters into a binding contract as soon as they submit the order and accept these terms and conditions. We are entitled to accept or reject the contract contained in the customer’s order within 5 business days from the date the order is received. A mere confirmation of receipt of the order does not constitute binding acceptance of the contract by us.

2.5. The contract is concluded by electronic means. The customer’s electronic acceptance of these terms and conditions, and the electronic messages and records exchanged between us, are valid, have legal effect and serve as evidence, under Electronic Transactions Law No. 3 of 2014.

2.6. Contracts are concluded for an indefinite period unless otherwise agreed.

2.7. Either party may terminate the contract by giving 30 days’ notice before the end of the month, without stating reasons. Different notice periods may apply to customers based on the description of the relevant services. Notice of termination is given in writing by postal letter or email, or through the customer’s account via our secure customer interface.

2.8. In addition, we reserve the right to terminate the contractual relationship without prior notice for good cause. Good cause exists, among other things, if the customer fails to meet payment obligations or breaches other material obligations. The customer’s use of content that harms the regular operation or the security of our infrastructure, or that breaches paragraphs (8.1) to (8.3) of these terms, is also cause for suspending the services or terminating the account without notice.

2.9. If the customer wishes to transfer their contractual rights and obligations to a third party, our prior written consent is required. The transfer request must be submitted in writing, whereupon we undertake to verify the capacity of the assignor and the identity of the third party.

3. Scope of services

In plain languageWe provide what the product description says when you order, we aim for 99.97% annual network availability, and we don’t guarantee a domain is allocated until it is confirmed.

3.1 The scope of the contractual service is determined by the product description in force at the time the customer places their order, and by the written agreements arising from it. We reserve the right, after giving prior notice, to discontinue services we provide free of charge or to charge fees for those services.

3.2 Where the subject of the contractual relationship is the registration of domain names, our obligation is limited solely to acting as an intermediary in the registration procedures for the requested domain. We accept no legal liability and give no guarantees as to whether the domain registration authorities will actually allocate the domain name the customer requested in their order. The customer may not assume that the domain name has been allocated to them until we have formally confirmed the allocation, as we have no influence over domain allocation decisions.

3.3 We undertake to make economically reasonable efforts to achieve an average annual network availability of 99.97% in our data centers.

3.4 Where the service includes the allocation of an Internet Protocol address (IP address), we do not check that address against blacklists, and the customer is not entitled to demand a specific IP address. We reserve the right to change the IP address allocated to the customer, where necessary, with prior written notice.

3.5 Where we provide technical support services beyond those set out in the service description, we invoice these services separately.

4. Payment terms and late payment

In plain languageWe bill you at the prices published on our site, electronic invoices are free, and late payment may incur a late-payment penalty.

4.1 Illevante Internet Services LLC invoices the customer for any contractually binding services at the current prices published on its website (www.illevante.sy), plus any taxes and fees the law may impose.

4.2 In accordance with the contractual agreement, we process monthly, quarterly or annual invoices through the agreed payment methods. The customer undertakes to comply with the terms and conditions of the payment service provider they use to pay their invoices.

4.3 Where we allow the customer to defer payment, we reserve the right, even without sending a reminder, to impose a late-payment penalty from the due date.

4.4 The customer undertakes to pay all fees and taxes arising from use of the service or through third parties authorized by the customer. Invoicing is free of charge exclusively in electronic form, while a corresponding fee is charged for delivery by paper mail.

5. Administrator rights and obligations / data security

In plain languageManaging and securing your server, and backing it up off the server, is your responsibility; using it for DDoS attacks means it is blocked and the contract ended.

5.1 The customer has full and sole administrator rights for all root and cloud server products. The customer alone is responsible for managing and securing these products, at their own expense and on their own responsibility.

5.2 By using our services, the customer undertakes to set up and manage their servers in a way that does not endanger the integrity and availability of third parties’ networks, servers and data. In particular, using the servers to launch denial-of-service (DDoS) attacks, or to run open mail relays or any other systems capable of such acts, is strictly prohibited. If the customer breaches this agreement, Illevante Internet Services reserves the right – without prior notice – to block the server and terminate the contract without prior warning.

5.3 For managed server products and services, we grant the customer basic usage rights only. We monitor these servers 24 hours a day to detect service outages, and we provide customer support free of charge for simple services. For more extensive services taking 15 minutes or more, we charge a flat service fee subject to prior agreement with the customer.

5.4 The customer undertakes to use the services provided properly and to refrain from any abusive or unlawful acts.

5.5 The customer is responsible for backing up their data regularly; these backups must be stored outside the server we provide. Where data is transferred to us on the customer’s servers, the customer undertakes to back up this data regularly. The customer also undertakes to make a full backup of the data before making any change, whether on their own behalf or on behalf of a third party. However, in the event of data loss, the customer undertakes to transfer the relevant data files to us again free of charge or to restore the data themselves.

6. Data protection

In plain languageWe process data under Syrian law and the international principles protecting privacy; if you process other people’s data on our services you are responsible for it, and we process it on your behalf under the Data Processing Agreement.

6.1 Personal data is processed in accordance with the laws in force in the Syrian Arab Republic and the general international principles protecting privacy set out in clause 13.3. Please refer to our Privacy Policy for more information, available at the following link: https://www.illevante.sy/legal-hub/privacy-policy

6.2 If the customer also wishes to process third parties’ personal data using our services, the customer alone remains responsible for it as the “data controller”, and we process it as the “data processor” on the customer’s behalf under the “Data Processing Agreement”, which forms part of these terms and conditions as clause 1.4 provides.

6.3 We hereby advise the customer that, as a general rule, we do not see the content of their services and are unable to determine whether or not the customer processes personal data. The customer therefore undertakes to provide us with the necessary information whenever they ask us for any action concerning this data, in particular whether third-party data is processed, for what purpose this data is processed, and which categories of personal data and of data subjects are concerned.

6.4 We hereby advise the customer that, given the current state of technology, there is as yet no fully comprehensive form of protection for data transmitted over the internet. The customer alone is responsible for the integrity and security of all data they store on any of their products.

7. Use by third parties

In plain languageYou can let others use your services, but you remain solely responsible to us for the contract’s obligations.

7.1 The customer may grant third parties a contractual right to use any of the services they order from Illevante Internet Services LLC. In this case, the customer remains the sole contractual partner and continues to be solely and fully responsible for compliance with the contractual agreements concluded between us and the customer.

7.2 If the customer transfers the usage rights to the services of Illevante Internet Services LLC to a third party, the customer undertakes, at the time of transfer, to ensure that all legal and contractual provisions are followed. This applies to any changes that require the third party’s cooperation.

7.3 If the third party breaches contractual obligations or fails to meet its duty to cooperate, or if the data provided by the third party is incorrect or incomplete, or if other problems arise in connection with granting usage rights to third parties, the customer bears full responsibility for all resulting damage and, in addition, undertakes to indemnify us against all claims brought against us by the third party or others.

8. Use of services and content

In plain languageUnlawful content, spam and cryptocurrency mining are prohibited, and we may block the account for violations.

8.1 The customer undertakes personally to verify and comply with the legal provisions arising from the use of the contractually agreed services, in particular the Syrian laws set out in clause 13.2 and the laws of the country where the data center hosting their service is located, as well as national and international industrial and intellectual property rights, personal rights, and the requirements of competition and data protection law. The customer acknowledges their obligation to indemnify and hold us harmless against all third-party claims arising from a breach of these obligations.

8.2 The customer undertakes not to publish any content that infringes the rights of third parties or otherwise violates applicable law. This includes in particular, without limitation, pornographic or obscene material, extremist content, content that offends public decency, gambling, or material that may seriously endanger the morals of children or young people or that infringes the rights of third parties (copyright, name rights, trademark rights and data protection rights). It also includes publishing content that contains defamation, insults or disparagement of persons or groups of persons.

8.3 Sending spam is prohibited. This includes in particular sending unauthorized and unsolicited advertising to third parties. When sending emails, it is also prohibited to give false sender details or to conceal the sender’s identity in any other way. Running cryptocurrency mining applications remains prohibited; this includes, without limitation, cryptocurrency mining, farming and plotting. We are entitled to block the customer’s access to the services of Illevante Internet Services or to their account in the event of non-compliance.

8.4 If we become aware of unlawful activities, we ask the customer to remove the infringing content immediately, we are entitled to block the customer’s access to the services of Illevante Internet Services or to their account, and we cooperate with the competent authorities in accordance with the law.

9. Liability

In plain languageOur contractual liability is limited: it excludes lost profits and, for simple negligence, does not exceed one month’s rent for the product, except where Syrian law does not allow a limit; the consequences of content violations are yours.

9.1 The customer uses the services of Illevante Internet Services LLC at their own risk. Our liability for indirect damage is limited to cases of fraud (intent) or gross fault only, and does not include liability for loss of profit (lost profits). In cases of negligent breaches of contractual obligations that do not amount to gross fault or intent, our liability is limited to foreseeable damage typical of this type of contract, up to a maximum not exceeding 100% of the monthly rent for the customer’s product.

9.2 If the customer breaches the content obligations set out in Article (8) of these terms and conditions, in particular with regard to legal prohibitions and violations of public morals, the customer is liable to us to compensate all direct or indirect damage arising from it, including financial losses. Furthermore, the customer undertakes to indemnify and hold us harmless against third-party claims – whatever their legal basis – resulting from the acts of the customer or of third parties appointed by the customer. This indemnification obligation also covers all legal defense costs incurred.

9.3 Neither this clause nor any other provision of our documents limits our liability where Syrian law does not allow it to be excluded or limited, in particular liability for fraud or gross fault, and liability arising from unlawful acts.

10. Limits of warranty

In plain languageWe provide our services as we describe them, and otherwise “as is” to the extent the law allows; our team’s advice is not legal or financial advice.

10.1 We provide our services according to their description published at the time of the order, and with the care of an ordinary person in this field. Beyond that, and to the extent the law allows, we provide the website and the services “as is” and “as available”, without any express or implied warranty of their fitness for a particular purpose of the customer.

10.2 Oral or written information or advice given by our team does not constitute legal or financial advice, and creates no warranty not set out in these terms and conditions.

10.3 This clause does not affect any right of the customer that the law does not allow to be agreed away.

11. Right of retention

In plain languageIf you don’t pay what you owe us within 10 business days of our notice, we may retain your equipment in the data center until you pay, without selling it except with your consent or a court’s permission.

Under the provisions on the right of retention in the Syrian Civil Code, we are entitled to refuse to return the equipment and devices installed in the data center by the customer, or by third parties on the customer’s behalf, for as long as the customer has not paid the amounts due to us arising from the contractual relationship, after notifying the customer of the debt and once 10 business days have passed from the date the customer receives the notice without payment. We look after this equipment for as long as we retain it, and we sell it only with the customer’s written consent or with a court’s permission; any amount of the price exceeding the debts and expenses in full is paid to the customer.

12. Cancellation and refunds

In plain languageYou may cancel a new service within 14 days without giving reasons (or the longer period stated on its page), and we refund what you paid within 14 days, except the value of the service already provided; domain fees are not refunded once sent to the registry.

12.1 The customer is entitled to cancel the contract for a new service within fourteen days from the date of its conclusion without giving any reason, unless the service’s page provides for a longer period (such as the 45-day money-back guarantee on cPanel hosting) or for refund terms of its own. To exercise the right of cancellation, the customer must notify us at Illevante Internet Services (address: Al-Suryan Al-Qadima, near the General Directorate of Customs, Aleppo, Syria; phone: +963 959 131 344; email: support@illevante.com) by means of a clear statement (for example, a letter sent by post, an email, or via the customer account in our secure online administration interface) of their decision to cancel the contract. It is sufficient for the customer to send this notice before the deadline expires.

12.2 Cancellation procedure: if the customer cancels the contract under clause 12.1, we will refund the amounts we received from them for the cancelled service immediately, and no later than fourteen days from the date we receive the notice of cancellation. The refund will be made using the same means of payment the customer used for the original transaction, unless the parties have expressly agreed otherwise. Under no circumstances will the customer bear any fees for this refund.

12.3 If the cancelled service had already begun at the time of cancellation, we will invoice the customer the pro rata amount corresponding to the service provided up to the date of cancellation, and deduct it from the refund.

12.4 The right of cancellation and refund does not apply to the fees for registering, renewing, transferring or redeeming domain names once the order has been sent to the domain registry, as these fees are paid to the registry immediately and it does not refund them. However, if the amount was charged and the domain was not activated because of a technical error, we solve the problem or return the amount to the credit balance in the customer’s account.

12.5 This clause does not affect any better right Syrian law gives the customer to withdraw from an electronic contract and recover what they paid.

13. Governing law and dispute resolution

In plain languageSyrian law governs these terms, together with the general international principles and without affecting your mandatory protections at home; we try to settle any dispute amicably within 30 days, then the courts of Aleppo hear it; domain disputes follow their registry’s policy.

13.1. These terms and conditions, the contractual relationship between us and the customer, and all services provided by Illevante Internet Services LLC are governed by and construed in accordance with the laws and legislation in force in the Syrian Arab Republic.

13.2. These laws include, without limitation, and as amended or replaced from time to time:

  • the Constitutional Declaration of the Syrian Arab Republic issued on March 13, 2025, which protects the inviolability of private life and makes the ratified international human rights conventions part of it;
  • the Civil Code issued by Legislative Decree No. 84 of 1949;
  • Commerce Law No. 33 of 2007;
  • Electronic Transactions Law No. 3 of 2014;
  • Law No. 7 of 2023 on digital signature and information technology services, which established NAITS (the National Agency for Information Technology Services), the authority responsible for the Syrian national domain .sy;
  • Law No. 12 of 2024 on the protection of personal data;
  • Law No. 20 of 2022 on combating cybercrime;
  • Telecommunications Law No. 18 of 2010;
  • Legislative Decree No. 8 of 2021 on consumer protection;
  • Legislative Decree No. 62 of 2013 on the protection of copyright and related rights, and Law No. 8 of 2007 on the protection of trademarks, geographical indications and industrial designs.

13.3. In our documents and in our dealings with our customers, we follow the general international principles on which they rest, including:

  • the Universal Declaration of Human Rights (1948), in particular Article 12 on the protection of private life;
  • the International Covenant on Civil and Political Rights (1966), to which Syria acceded in 1969, in particular Article 17 on the protection of private life and correspondence;
  • the United Nations Guidelines for Consumer Protection, as revised in 2015;
  • the Guidelines for the Regulation of Computerized Personal Data Files adopted by the United Nations General Assembly in 1990;
  • the UNCITRAL Model Law on Electronic Commerce (1996);
  • the Paris Convention for the Protection of Industrial Property and the Berne Convention for the Protection of Literary and Artistic Works, both of which Syria has joined;
  • the policies of the Internet Corporation for Assigned Names and Numbers (ICANN) for generic top-level domains, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP) and the Expired Registration Recovery Policy (ERRP).

13.4. Protection that cannot be waived: choosing Syrian law does not deprive a customer resident outside Syria of the protection given to them by the mandatory provisions of the law of their country of residence, which cannot be departed from by agreement.

13.5. Amicable settlement (amicable resolution): if any disagreement, claim or dispute arises in connection with this agreement or with the use of our services, the customer agrees first to attempt to resolve the dispute amicably and in good faith, by communicating directly with the management of Illevante Internet Services LLC through our approved official communication channels, and by giving the company a period of no less than 30 days to respond and address the problem.

13.6. Jurisdiction: if an amicable settlement of the dispute cannot be reached within the above period, the parties agree to refer the dispute exclusively to the competent Syrian courts in the city of Aleppo, and these courts are the sole body authorized to hear any claims or legal proceedings arising from this agreement. However, we are entitled to take legal action before the competent court at the customer’s place of residence or business. Mandatory statutory provisions on jurisdiction remain unaffected.

13.7. Domain name disputes: disputes relating to the ownership or use of domain names (such as claims of infringement of third parties’ trademarks) are excluded from the preceding clauses, and are governed: for generic top-level domains (gTLDs), by the “Uniform Domain-Name Dispute-Resolution Policy” (UDRP) adopted by the Internet Corporation for Assigned Names and Numbers (ICANN); for the Syrian national domain .sy and its extensions, by the general conditions for registering domain names under the Syrian top-level domain issued by NAITS, under which NAITS settles the dispute on a formal complaint by either party, and a party that does not accept its settlement may go to the competent Syrian courts; and for other country-code domains, by each registry’s policy. The customer must follow the procedures set out in the policy concerned to resolve any dispute with third parties over the domain name.

14. Customer reviews

In plain languageReviews are for people who have dealt with us, from their real experience; we publish high and low ratings without editing, hold back only what breaks the rules, and you may delete yours at any time.

14.1 This clause applies to every review sent through the “Customer reviews” page of our website, and sending a review constitutes acceptance of it. Personal data contained in a review is processed in accordance with item 9, “Customer reviews”, of the privacy policy. Reviews written on external platforms, such as Trustpilot, are subject to those platforms’ terms and policies, and this clause does not apply to them.

14.2 Anyone who has actually dealt with us may write a review: a current or former customer, or someone who has contacted our technical support, customer service or sales teams. The reviewer confirms that the review reflects their genuine personal experience, and that they are not writing it on behalf of someone else, nor as an employee of ours or of a competitor.

14.3 A review may not contain: content that is unlawful, abusive or defamatory or that incites hatred; personal data of anyone other than its author; login credentials or confidential information; links, advertising or spam; impersonation of another person; or anything unrelated to our services or to its author’s dealings with us.

14.4 We offer no payment, discount or benefit in return for writing, changing or deleting a review; we do not write reviews in our customers’ names; and we do not publish reviews of our services written by our employees or by anyone working on our behalf. No one may send fake, duplicate or paid reviews.

14.5 We read every review before publishing it to check that it complies with this clause. We publish high and low ratings alike, we do not edit their text, and we do not hold back a review because of its rating or because it criticises us, but only for breaching clause 14.3 or 14.4; we keep a review we hold back in our internal records without publishing it. Publishing a review does not mean that we confirm what it says.

14.6 The reviewer keeps their rights in the review and, by sending it and agreeing to its publication, grants us a non-exclusive, free licence to publish and display the review and the name they chose on our website, on the “Customer reviews” page, the page of the service it reviews and the home page, and to include them in the structured data that search engines read, without changing its substance. This licence lasts for as long as the review stays published, and ends with a request to delete it under clause 14.8. We may choose some reviews to highlight, without this changing the averages and figures shown, which are calculated automatically from all published reviews.

14.7 We may reply publicly to any review in the name of Illevante, and the reply is published beneath it. We do not disclose any data about the customer’s account or services in our replies without their consent. We may use the email address sent with a review to confirm that its author is our customer; “Verified customer” appears beside their name only once that is confirmed, and the email address is never published.

14.8 The reviewer may at any time ask us to delete their review or change the name shown with it, by writing to data-protection@illevante.com from the email address the review was sent from. The text of a published review is not edited; its author may send a new review to replace it.

14.9 Reviews express the opinions of their authors alone. The reviewer is responsible for what they write in the review and undertakes to indemnify and hold us harmless against third-party claims arising from their breach of this clause.

15. Final provisions and continuity clause

In plain languageThe Arabic text is the reference, we correspond by email and through your account, we aren’t liable for force majeure, and if any clause is invalid the rest remain valid.

15.1 Language of the documents: these terms and conditions and our legal documents are written in Arabic, and the English version is a translation of them; in the event of any difference between the two, the Arabic text prevails.

15.2 Notices: we send our notices to the customer through their account or to the email address registered in it, or by publishing them on the website where they concern customers generally, and they take effect from the time they are sent or published. The customer is responsible for keeping their email address up to date. The customer sends notices to us through their account, by email to support@illevante.com, or by registered mail or hand delivery to our address: Al-Suryan Al-Qadima, near the General Directorate of Customs, Aleppo, Syria.

15.3 Force majeure: we are not liable for failing to perform our obligations, or for delay in performing them, where this results from an external cause beyond our control, such as force majeure or a sudden event, including, without limitation, natural disasters, wars and hostilities, civil unrest, epidemics, government action, power outages or the failure of communications and internet links, and hostile attacks on the network, for as long as that cause lasts.

15.4 No waiver: our not exercising any right, or our delay in enforcing any provision of these terms, is not a waiver of it, and a waiver is valid only in writing.

15.5 Severability: if any provision of these terms is invalid or unenforceable, in whole or in part, this does not affect the validity and enforceability of the remaining provisions. The same applies if this contract is found to contain any gap or omission. The invalid or unenforceable provision is replaced by an appropriate provision that comes as close as legally possible to the meaning and purpose of the original provision or to the presumed intention of the parties, as if they had taken this point into account when concluding the contract.

15.6 Entire agreement: these terms and conditions, together with the documents listed in clause 1.4 and what was agreed in writing in the order or the service description, form the entire agreement between us and the customer on their subject.

15.7 Continuity: provisions that by their nature survive the end of the contract remain in force after it ends, including those on liability, indemnification, confidentiality, governing law and dispute resolution.
